1. Introduction and Scope

1.1. This website is owned and operated by Apollo Brain Concepts (Pty) Ltd (Registration No: 2016/291996/07). 1.2. These Terms apply to all users, including guests and registered members. By using this site, you warrant that you have the legal capacity to enter into a binding agreement.

2. Service Description and Pricing

2.1. Apollo Brain Concepts provides specialized printing services for offline marketing materials. 2.2. Quotations: Only official quotations generated via the website or issued by our team are valid. Quotations remain valid for seven (7) days unless otherwise specified. 2.3. Pricing Adjustments: We reserve the right to adjust pricing at any time. In the event of a manifest error in pricing, we reserve the right to cancel or refund orders placed at the incorrect price. 2.4. VAT: Apollo Brain Concepts is currently not a VAT vendor; therefore, all prices quoted are the final amounts payable and do not include Value Added Tax.

3. Payment and Financial Terms

3.1. Payments are processed via the Yoco payment gateway integrated with our WooCommerce platform, or via electronic funds transfer (EFT). 3.2. Security: By using the Yoco gateway, users agree to abide by Yoco’s terms of service and security protocols. 3.3. Currency: All transactions are processed in South African Rand (ZAR).

4. User Submissions and Intellectual Property

4.1. Ownership: Users retain ownership of their Material Designs. By uploading content, you grant Apollo Brain Concepts a non-exclusive license to reproduce the design for the sole purpose of fulfilling your order. 4.2. Compliance: You warrant that your submissions do not infringe on any third-party intellectual property rights and are not defamatory or unlawful. 4.3. Responsibility: While we may perform basic automated file checks, the User remains 100% responsible for the accuracy, spelling, grammar, and layout of the final artwork.

5. Production and Quality Standards

5.1. Colour Accuracy: Due to the nature of CMYK gang-run printing, an exact match to on-screen (RGB) colours cannot be guaranteed. Minor colour deviations are not grounds for a reprint. 5.2. Technical Deviations: Users acknowledge that minor deviations in cutting or folding (up to 2mm for brochures and 1mm for other products) are industry standard and may occur. 5.3. Quantity: We reserve a 10% margin for over-runs or under-runs. In the event of an under-run exceeding 10%, store credit will be issued for the missing units.

6. Delivery and Risk

6.1. Delivery timelines begin only once an order is marked as “In Production.” 6.2. Apollo Brain Concepts is not liable for delays caused by third-party couriers, incorrect address data provided by the user, or Force Majeure events (including power failures/loadshedding and strikes).

7. Cancellations, Refunds, and Reprints

7.1. Cancellations: Orders cannot be cancelled once they have reached the “In Production” status. 7.2. Refunds: As our products are custom-made to user specifications, they are exempt from the general right of return under Section 20 of the Consumer Protection Act. Refunds are granted at our sole discretion and are typically issued as store credit. 7.3. Reprint Policy: Any defects must be reported within 14 days of delivery with digital photographic evidence.

8. Limitation of Liability

8.1. To the maximum extent permitted by law, Apollo Brain Concepts provides its services on an “as is” basis. We shall not be liable for any indirect or consequential damages arising from the use of the website or the delivery of goods.

9. Governing Law

9.1. These terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the South African courts.
